These Terms & Conditions (“Agreement”) govern the application, evaluation, and potential engagement of independent-contractor tutors (“Applicant,” “you,” or “your”) by GeniusLab LLC (“GeniusLab,” “we,” “us,” or “our”). By submitting any application form or related information, you agree to the following terms.

1. Purpose of Application

The GeniusLab tutor application process enables GeniusLab to evaluate candidates for tutoring opportunities within the United States. Submission of an application does not guarantee engagement or compensation. GeniusLab reserves full discretion to accept, reject, or discontinue consideration of any application.

2. Applicant Representations

You represent and warrant that:

1. All information you provide is true, complete, and not misleading.

2. You possess the qualifications and legal authorization to perform tutoring services within the United States.

3. You will promptly update GeniusLab regarding any material change to information provided.

False or misleading statements may result in immediate disqualification or termination of any engagement.

3. Independent-Contractor Status

If engaged, you will perform services as an independent contractor, not an employee. Nothing in this Agreement creates an employment, partnership, or agency relationship. You are solely responsible for federal, state, and local taxes, insurance, and all costs associated with your tutoring activities.

4. Application Data Collected

GeniusLab may collect and process:

• Personal identifiers (name, address, phone, email).

• Educational background, certifications, and résumé materials.

• Tutoring experience, subjects, grade levels, and availability.

• References and verification contacts, including families you have tutored.

• Optional documents (transcripts, credentials, background-check results).

Data are collected directly from you and used for the purposes described below.

5. Use of Data

GeniusLab may use the collected information to:

1. Evaluate your suitability for tutoring opportunities.

2. Verify your background and prior experience.

3. Communicate with you regarding application status, onboarding, or opportunities.

4. Maintain internal records, quality control, and compliance with applicable law.

6. Use of Family Contact Information

If you list families you have tutored, you confirm that you have obtained their permission for GeniusLab to contact them.
GeniusLab may contact those families:

1. to verify your tutoring experience;

2. to provide details about GeniusLab’s tutoring services, free evaluations, promotions, or educational resources; and

3. to follow up about their interest in tutoring programs.

GeniusLab will clearly identify itself in every communication, will explain that the family’s information originated from your application, and will honor any request not to receive further messages. GeniusLab does not sell or rent family contact information to third parties. All communications are handled in accordance with applicable privacy and anti-spam laws, including the CAN-SPAM Act and the Telephone Consumer Protection Act (TCPA).

7. Data Retention and Security

GeniusLab retains application data for up to three (3) years or as required by law. Reasonable administrative, technical, and physical safeguards are implemented to protect data from unauthorized access, loss, or misuse. Despite such safeguards, no system is entirely secure, and GeniusLab disclaims liability for unauthorized access beyond its reasonable control.

8. Data Disclosure to Third Parties

GeniusLab may share limited applicant data with trusted service providers—such as background-check vendors, cloud-storage providers, and communication platforms—strictly for operational purposes and under confidentiality obligations. GeniusLab does not sell personal data.

9. Communications Consent

By submitting your application, you consent to receive emails, calls, or text messages from GeniusLab or its authorized partners regarding your application, verification, and potential opportunities. Standard messaging rates may apply. You may withdraw consent to non-essential communications by contacting Contact@YourGeniusLab.com.

10. Background Checks and Verification

Depending on the jurisdiction or assignment, GeniusLab may conduct background checks, education verification, or fingerprinting prior to any engagement. You authorize such screenings in compliance with federal and state law.

11. Confidentiality

All non-public information obtained through the application or onboarding process—including internal procedures, pricing, training materials, or client information—is confidential and may not be disclosed or used for purposes outside the evaluation or performance of services for GeniusLab.

12. Referral and Incentive Programs

GeniusLab may offer referral or incentive programs to tutors who introduce new students or families. Participation is voluntary and subject to separate written terms that may be modified or terminated at any time.

13. Intellectual Property

All materials, curricula, and systems supplied by GeniusLab remain the exclusive intellectual property of GeniusLab. Independent contractors may use such materials solely for tutoring services performed under GeniusLab.

14. Applicant Withdrawal and Data Deletion

You may withdraw your application or request deletion of your data by emailing Contact@YourGeniusLab.com. GeniusLab will confirm receipt and, where permitted by law, delete identifiable personal data within a reasonable timeframe.

15. Limitation of Liability

To the fullest extent permitted by law, GeniusLab and its officers, directors, employees, and agents shall not be liable for indirect, incidental, or consequential damages arising from your application or any use of the website or systems. GeniusLab’s total liability, if any, shall not exceed one hundred U.S. dollars ($100).

16. Indemnification

You agree to indemnify and hold harmless GeniusLab from any claims, losses, or expenses arising out of (a) your breach of these Terms, (b) your misrepresentation of information, or (c) your violation of any law in connection with your application or services.

17. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the United States of America and, to the extent applicable, the laws of the state in which a dispute arises, without regard to conflict-of-law principles. Any controversy or claim shall be resolved through binding arbitration conducted under the rules of the American Arbitration Association. Each party shall bear its own costs, and arbitration shall occur in a mutually agreed location within the United States.

18. Modification of Terms

GeniusLab may amend or update these Terms & Conditions at any time by posting a revised version on its website. The “Last Updated” date at the top will reflect the effective date. Continued participation in the application process after such posting constitutes acceptance of the revised Terms.

19. Severability

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

20. Entire Agreement

This Agreement constitutes the entire understanding between GeniusLab and the Applicant regarding the application process and supersedes all prior or contemporaneous communications, whether oral or written.
